§ 1. General provisions

  1. These Terms set out the rules for using the kompasmigracji.com website (the “Website”), for services provided electronically, and for concluding and performing service contracts, including distance contracts.
  2. The service provider is DOMUS V Sp. z o.o., Warsaw, ul. Dzieci Warszawy 27C/49, 02-495 Warszawa, entered in the KRS register under no. 0001198474 (Sąd Rejonowy dla m.st. Warszawy w Warszawie, XIV Wydział Gospodarczy KRS), NIP 5223350030, REGON 542936213, share capital 5 000 zł (the “Provider”). Kompas Migracji is the Provider’s brand. Contact: Kompas.Migr@gmail.com, phone and WhatsApp +48 729 271 848.
  3. Definitions: “Client” — a person using the Website or ordering a Service; “Consumer” — a natural person entering into a contract not directly related to their business or profession (Art. 22¹ of the Polish Civil Code); “Sole trader with consumer rights” — a natural person running a business for whom the contract has no professional character (Art. 38a of the Consumer Rights Act); “Service” — a paid service under § 3(1); “Electronic Services” — services under § 3(2); “Business hours” — Monday–Friday, 9:00–18:00 Warsaw time, excluding public holidays; “Durable medium” — e.g. an email or a PDF file.
  4. The Terms are available free of charge on the Website and can be downloaded, saved and printed.

§ 2. Who provides the Services and what they do not include

  1. Services are provided by the Provider’s employees and associates. The Provider is not a law firm of advocates (adwokat) or legal advisers (radca prawny).
  2. In administrative proceedings (e.g. before the voivode and the Head of the Office for Foreigners) the Provider or a person it designates may act as the Client’s representative under a power of attorney (Art. 33 KPA) if the contract so provides. The PLN 17 stamp duty on the power of attorney is not included in the price.
  3. Before the voivodeship administrative court (WSA) and the Supreme Administrative Court (NSA) a representative may, as a rule, only be an adwokat or radca prawny (Art. 35 § 1 p.p.s.a.). In such cases the Provider drafts the complaint, which the Client signs and files. Court representation, if the Client wishes, is provided by a cooperating adwokat or radca prawny under a separate contract and fee. A cassation appeal to the NSA may only be drafted by an adwokat or radca prawny (Art. 175 p.p.s.a.).
  4. The Provider is not a notary or a sworn translator. It drafts documents and arranges their certification by a notary or consul and their translation by a sworn translator. Notarial fees, apostille and translator fees are not included unless the Service description says otherwise.
  5. The Provider does not act as an employment agency and does not place people in jobs.
  6. A Service contract is a contract of due diligence (Art. 750 of the Civil Code with the provisions on mandate). The Provider does not guarantee a specific outcome — decisions are made by the authority or the court. The Provider does not offer to “speed up” cases other than through legal remedies (ponaglenie — Art. 37 KPA; complaint about inaction or excessive length — Art. 3 § 2(8) p.p.s.a.).

§ 3. Types of services

  1. Paid Services under the Website price list or an individual quote: consultations; case audits; drafting applications (including help with filing in the MOS system), letters, appeals, ponaglenie and draft complaints; handling administrative cases under a power of attorney; drafting powers of attorney and statements; arranging sworn translations; help with other official matters.
  2. Free Electronic Services: contact and request forms; calculators and tools (deadlines, income criterion); the AI assistant and AI document check; the client portal accessed with a PIN; the blog and guides. Tool results and AI assistant answers are indicative and are not legal advice.
  3. A contract for an Electronic Service is concluded when the Client starts using it — for an indefinite period for the client portal and for the time of use for other features. The Client may terminate it at any time without giving reasons by stopping use or, for the client portal, by requesting removal of access at Kompas.Migr@gmail.com.

§ 4. Technical requirements and rules of use

  1. You need a device with internet access and an up-to-date browser (Chrome, Firefox, Safari, Edge) with JavaScript and cookies enabled; for contact — an email address or a phone number (WhatsApp, Telegram or Viber); for online payment — online banking, BLIK or a payment card.
  2. Providing unlawful content is prohibited (Art. 8(3)(2) of the Act on Providing Services by Electronic Means), including third-party data without a legal basis and offensive or infringing content, as is disrupting the Website.
  3. Using the internet involves risks such as malware, phishing and interception of data on unsecured networks. The Provider never asks for banking passwords or BLIK codes via messengers and accepts payments only via Przelewy24 or by transfer to the account in § 6.
  4. Please do not send particularly sensitive data (e.g. health data) or children’s documents through forms or the AI assistant unless necessary. Data processing is described in the Privacy Policy.

§ 5. Concluding a Service contract

  1. Fixed-price Service ordered on the Website: the Client selects the Service, enters their details, accepts the Terms and clicks a button involving an obligation to pay (e.g. “Go to Przelewy24”). The contract is concluded when the order is placed. The Provider confirms the contract on a Durable medium (email) without delay and at the latest before performance starts (Art. 21(1) of the Consumer Rights Act).
  2. Individually priced Service: the contract is concluded when the Client accepts the Provider’s offer (email or messenger) or signs a contract.
  3. Before the contract is concluded, the Provider informs the Client of the scope of the Service, the total price and any costs not included (e.g. official fees).
  4. The consultation fee is credited towards the price of a Service ordered afterwards in the same matter.

§ 6. Prices and payment

  1. Prices are in Polish zloty and are final prices for the Client. They do not include official fees (stamp duty, residence card fee, court fee), notarial fees, apostille or sworn translations unless the Service description says otherwise.
  2. Payment can be made via Przelewy24 (PayPro S.A.) — BLIK, online transfer or card — or by bank transfer to the Provider’s account at ING Bank Śląski: PL10 1050 1025 1000 0090 8594 6938.
  3. Fixed-price Services are paid in advance unless agreed otherwise (e.g. in stages). Payment confirmation is sent by email; an invoice is issued at the Client’s request.

§ 7. Timelines

  1. Reply to an enquiry sent via form, WhatsApp or email — within 2 Business hours.
  2. Start of a paid Service (contact from the person handling the case) — within 24 Business hours of the payment being booked.
  3. Drafting documents — within 3 business days of receiving complete information and documents from the Client, unless the contract or Service description provides otherwise.
  4. Where a statutory deadline runs (e.g. 14 days to appeal), the Provider prepares the document before it expires, provided the Client has delivered all documents at least 3 business days before the deadline.
  5. The AI assistant, tools and client portal work around the clock; staff reply during Business hours.

§ 8. Right of withdrawal

  1. A Consumer or a Sole trader with consumer rights may withdraw from a distance contract within 14 days of its conclusion without giving reasons (Art. 27 and Art. 28(4) of the Consumer Rights Act).
  2. The withdrawal may be made using the form in Annex 1 to these Terms or in any other unequivocal way — by email to Kompas.Migr@gmail.com or by letter to the registered office. Sending the statement before the deadline is sufficient.
  3. If the Consumer expressly requested performance to begin before the withdrawal period ends and then withdraws, they pay for the services provided up to withdrawal, in proportion to the scope performed; if the price is excessive, the market value is used (Art. 35 of the Consumer Rights Act).
  4. The right of withdrawal does not apply once the Provider has fully performed the Service with the Consumer’s express prior consent, the Consumer having been informed before performance began that they would lose the right of withdrawal once the Service is fully performed and having acknowledged this (Art. 38(1)(1) of the Consumer Rights Act).
  5. The Provider refunds payments without undue delay and no later than 14 days after receiving the withdrawal, using the same payment method as the Consumer, unless the Consumer agrees to another method at no cost to them (Art. 32 of the Consumer Rights Act).

§ 9. Complaints

  1. Complaints can be sent by email to Kompas.Migr@gmail.com, via WhatsApp +48 729 271 848 or by letter to the registered office. Please include your contact details, a description of the problem and the resolution you expect.
  2. The Provider handles complaints within 14 days of receipt and replies on a Durable medium. If the Provider does not reply to a Consumer’s complaint within that time, the complaint is deemed accepted (Art. 7a of the Consumer Rights Act).
  3. Complaints about Electronic Services are handled in the same way.

§ 10. Liability

  1. The Provider is liable for non-performance or improper performance of the contract under the general rules of the Civil Code. Nothing in these Terms excludes or limits liability towards Consumers where the law does not allow it.
  2. The Provider is not liable for the content of decisions of authorities and courts, for the consequences of untrue or incomplete information from the Client or of documents delivered after the time in § 7(4), or for acts and omissions of authorities, postal operators and payment operators.
  3. Towards Clients who are neither Consumers nor Sole traders with consumer rights, the Provider’s liability is limited to actual loss and to the fee paid for the Service concerned, except for damage caused intentionally (Art. 473 § 2 of the Civil Code).
  4. Blog content, calculator results and AI assistant answers are general and indicative and do not replace an analysis of a specific case.

§ 11. Personal data

  1. The controller of Clients’ personal data is DOMUS V Sp. z o.o.. Purposes, legal bases, recipients (including AI and payment service providers), retention periods and the Client’s rights are described in the Privacy Policy.

§ 12. Out-of-court dispute resolution

  1. A Consumer may use out-of-court complaint and redress procedures, in particular free help from a municipal or district consumer ombudsman (rzecznik konsumentów), mediation by the voivodeship inspector of the Trade Inspection (Inspekcja Handlowa) or the permanent consumer arbitration court at that inspector. Information: prawakonsumenta.uokik.gov.pl.
  2. Participation in out-of-court proceedings is voluntary for both parties.

§ 13. Amendments and final provisions

  1. The Provider may amend these Terms for important reasons: changes in law, in the scope of Services, in the Provider’s details or in technical requirements. An amendment applies from the date stated on publication; contracts concluded earlier are governed by the version in force when they were concluded. A client portal user may terminate the contract if they do not accept the changes.
  2. Contracts are governed by Polish law. This choice does not deprive a Consumer of the protection of mandatory provisions of the country of their habitual residence. Disputes with Clients who are not Consumers are resolved by the court competent for the Provider’s registered office.
  3. The Polish version of these Terms is binding; translations are for information only. Previous versions: Archive of previous versions.
